Recently, the California Energy Efficiency Commission's CEC certification has begun random inspections on the market, conducting certification verification work for products within the scope of CEC Title 20 control, and removing non-compliant or uncertified products and penalizing them. The specific market supervision requirements are in the new Title 20 electrical energy efficiency regulations officially announced by CEC on July 23, 2021: CEC-140-2021-002.

CEC California Electrical Appliance Energy Efficiency Regulations incorporates the United States federal regulations and standards, and sets the lowest energy and water consumption energy efficiency levels for consumer electronics, household appliances and plumbing drainage devices. At the same time, the regulations stipulate that products controlled by electrical regulations that enter the California market for circulation and sales must meet the product sales market management requirements.

CEC Title 20 market supervision requirements are as follows:

1. Products controlled by CEC Title 20 must be qualified in the MAEDbS system before being listed.

2. CEC Title 20 requires manufacturers to complete the following three steps:

? Testing§ 1603. Testing: All Appliances.,

? Mark § 1607. Marking of Appliances.,

? Listing § 1606. Filing by Manufacturers; Listing of Appliances in the MAEDbS.

3. If a CEC Title 20 controlled product is not listed in the MAEDbS system before it goes on the market, once discovered, the CEC market supervision department will take legal measures to require removal and prohibit sales.

4. The CEC Title 20 market supervision department can request a test report from the manufacturer at any time. The manufacturer must provide a test report within 5 days of receiving the CEC request. Products that do not provide a test report within the specified time will be deleted by CEC from MAEDbS Column name.

5. After CEC completes the sampling test, if the tested power consumption is higher than the declared value, or the energy efficiency is lower than the declared value, CEC will notify the modification of the listed value of MAEDbS.

6. After CEC completes the sampling test, if the test value does not meet the requirements of the CEC Title 20 standard, the CEC market supervision department will notify the manufacturer of the product to be deleted from the MAEDbS after 10 days.

7. CEC will conduct periodic spot checks on the products sold on the market. The items to be spot checked include: performance and labeling.

8. The implementation and inspection regulations for performance testing of market products are as follows:

(1) Initial test. Choose 1 sample:

A. If the test result is not lower than the standard requirements, nor lower than the initial third-party report certification value, the random inspection is qualified and the test is closed.

B. If the test result is lower than the standard requirement and also lower than the initial third-party report certification value, a second sample test will be selected.

(2) Second test.

A. If the average value of the two tests is not lower than the standard value requirement, nor lower than the initial third-party report certification value, the random inspection is qualified and the test is closed.

B. If the average value meets the requirements of the standard value, but is lower than the initial third-party report certification value, the executive officer will modify the listed value to ensure that it reflects the actual test value of the product.

C. If the average value is lower than the standard value requirement, CEC will remove the product listing.

9. Sampling inspection cost requirements: In addition to the cost of 8(1)A and 8(2)A, the California Energy Commission will bear the cost of the initial inspection, and the cost of testing in all other cases will be paid by the manufacturer.

10. If the results of CEC Title 20 market sampling do not meet the requirements of the energy efficiency standards governed by the US Federal Regulations, CEC will also simultaneously report to the US Federal Government Energy Efficiency Department DOE.

11. Within 10 days after the CEC market supervision department announces the market sampling decision, the manufacturer can file a written complaint with CEC and submit all the evidence at the same time. The CEC market supervision department will submit all the evidence to the California Energy Efficiency Commission within 20 days, and the committee will receive it within 20 days. Hearing opinions and handling the appeal case shall be heard within at least 30 days after the appeal.

12. Anyone, including retailers, manufacturers, importers, and distributors who sell CEC controlled products that are not included in the MAEDbS system, will violate the provisions of 1608(a)(1) and will be subject to administrative civil penalties.
